GENERAL
We are delighted that you are interested in DUO PLAST AG and are applying or have applied for a position within our company. We would like to provide you with the following information regarding the processing of your personal data in connection with the application, as data protection is very important to us. We strictly adhere to the legal provisions when processing your application. These are, in particular, the European General Data Protection Regulation (’GDPR’) and the new German Federal Data Protection Act (Bundesdatenschutzgesetz, ‘BDSG new’).

TYPES OF DATA AND PURPOSES OF PROCESSING
We process the data which you have sent us in connection with your application in order to check your suitability for advertised positions and to carry out the application process.
The application process requires that applicants provide us with their application data. The necessary application data includes personal details, postal and contact addresses and the documents belonging to the application, such as a cover letter, curriculum vitae, references and certificates (in the case of online forms, indicate the requested data types and add the requested attachments). Applicants can also voluntarily provide us with additional information.
In addition, we may receive data from third parties (e.g. personnel consultants).
LEGAL BASIS
The primary legal basis for the processing of your personal data in this application process is Art. 88 GDPR in conjunction with Sec. 26 BDSG in the version applicable from 25 May 2018. According to which, the processing of the data required in connection with making a decision on the establishment of an employment relationship is allowed.
If you voluntarily provide us with special categories of personal data within the meaning of Art. 9 (1) GDPR as part of the application process, they will also be processed pursuant to Art. 9 (2) (b) GDPR (e.g. health data, such as severe disabilities or ethnic origin).
Insofar as we request special categories of personal data from you within the meaning of Article 9 (1) GDPR as part of the application process, they will also be processed pursuant to Article 9 (2) (a) GDPR.
If the data is required for legal prosecution after the application process has been completed, data processing may take place on the basis of the requirements of Article 6 GDPR, in particular to protect legitimate interests according to Art. 6 (1) (f) GDPR. Our interest then lies in the assertion or defence of claims.
If you have granted us your consent to include your application documents in our talent pool, the legal basis for this is Art. 6 (1) (a) or Art. 9 (2) (a) GDPR.
STORAGE PERIOD
Your personal data will initially be stored for the duration of the application process and for 6 months in the event of a rejection and then erased, in order for us to answer any follow-up questions regarding the application and meet our obligations to provide evidence under the German Equal Treatment Act [Gleichbehandlungsgesetz].
In the event that you have agreed in writing to the further storage of your personal data, we will transfer your data to our pool of applicants. The data will be erased in this regard after two years.
If you have been offered a position as part of the application process, the data will be transferred to our personnel information system and processed by us for the purposes of the employment relationship.
Receipts/booking data for any reimbursement of travel expenses or costs are archived in accordance with tax regulations.
DISCLOSURE TO THIRD PARTIES
External service providers may be used for the destruction of files and data carriers, as well as for the support of our IT systems, however, they are all contractually obligated to comply with data protection regulations.
Your application data will be viewed by the Personnel department after your application has been received.
You will receive confirmation of receipt in advance using the contact details you have provided us with for correspondence. Suitable applications are then forwarded internally to the department responsible for the respective position. Further processing is coordinated. In principle, only those people in the company have access to your data who require it for the proper running of our application process.
Your data is processed exclusively in data centres within the Federal Republic of Germany.
THE RIGHTS OF DATA SUBJECTS
You have the right to information about the personal data we process that relates to you. You also have the right to rectification, erasure or to the restriction of processing. In addition, you have a right to object to the processing within the framework of the statutory provisions. Finally, you have the right to data portability (Art. 20 GDPR) as soon as you have made the processed data available.
If data processing is based on consent pursuant to Art. 6 (1) (a) or Art. 9 (2) (a) GDPR, you can withdraw such consent at any time with effect for the future without affecting the legality of the previous processing.
You are welcome to contact us at any time to exercise your legal rights.
In the case of a request for information that is not made in writing, please understand that we may then request evidence from you that proves that you are the person you say you are.
You have the right to lodge a complaint with a supervisory authority. Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your place of residence, your place of work or the place of the alleged infringement, if you believe that the processing of your personal data violates the GDPR. The supervisory authority to which the complaint has been lodged will then inform the complainant about the status and the outcome of the complaint, including the possibility of a judicial remedy pursuant to Art. 78 GDPR.

NOTE ON SUBMITTING APPLICATIONS
Applicants can submit their applications by post or by email. However, we ask you to note that emails are generally not sent in encrypted form and that the applicants themselves must ensure encryption. We can therefore assume no responsibility for the transmission path of applications from the sender to receipt on our server. If the applicant has concerns about security when sending the application documents by email, we recommend sending them by post.
RIGHT TO LODGE A COMPLAINT
You have the right to lodge a complaint about the processing of personal data by us with our data protection officer or to the responsible data protection supervisory authority.
